The EPA does not regulate private wells — the responsibility falls entirely on the homeowner. Florida Regulations for Well Water Testing

Florida regulates septic systems through the Florida Department of Environmental Protection (DEP) and county health departments. Two separate things are often confused here. The Clean Waterways Act moved regulatory authority from the Department of Health to DEP on 1 July 2021, and the rule chapter went with it — Chapter 64E-6 was transferred to Chapter 62-6, F.A.C. Field permitting is transferring on a slower, phased schedule: on 2 January 2025 DEP took over permitting and inspections in sixteen Panhandle counties, Escambia east to Jefferson, plus Marion, working from service hubs in Pensacola, Panama City and Tallahassee. Everywhere else the county health department still issues the permit, under DEP’s rules. Separately from all of that, DEP’s Basin Management Action Plans designate nutrient-impaired watersheds where new and replacement systems can be required to use Enhanced Nutrient Reduction technology — a watershed boundary, not a county one. A new installation needs a site evaluation, a construction permit and inspections at several stages. Florida mandates a minimum of 24 inches of unsaturated soil below the drain field bottom — a challenging requirement given the state's notoriously high water tables, which can be as shallow as 12 inches below grade in coastal areas. Systems must be set back 75 feet from wells and 50 feet from surface water. The state requires septic inspections for real estate transactions in many counties.

Licensing Requirements

Florida moved septic contractor regulation from the Department of Health to the Department of Environmental Protection on 1 July 2021 under the Clean Waterways Act, and the rules moved with it — Chapter 64E-6, F.A.C. was transferred to Chapter 62-6. A registered septic business holds two credentials on two different clocks: the business Certificate of Authorization runs two years and expires 31 March of odd years, while the registered septic tank contractor standing behind it renews every year on 30 September. The earlier date is the one that governs. Water well contractors are licensed separately under Rule 62-531, F.A.C., on a two-year cycle, and that licence is valid statewide regardless of which water management district issued it. Permitting is a separate question from licensing: county health departments still issue septic permits across most of Florida, but DEP took over field permitting in sixteen Panhandle counties and Marion on 2 January 2025.

Environmental Considerations

Florida's biggest septic challenge is its high water table — in many coastal and central areas, groundwater sits just 12 to 24 inches below the surface, severely limiting conventional drain field options. Sandy soils in most of the state provide excellent percolation but minimal treatment, raising concerns about nutrient loading into springs, lakes, and the Indian River Lagoon. The new BMAP regulations represent the state's most aggressive effort to address septic nutrient pollution, requiring nitrogen-reducing systems that can cost two to three times more than conventional installations. Hurricane and flood damage to septic systems is a recurring issue in coastal counties.
