Minnesota Septic Regulations

Local governments β€” counties and cities β€” are delegated primary enforcement responsibility under Chapter 7083, and most permitting occurs at the county level. Minnesota's compliance inspection program requires that all ISTS be inspected within three years of a real estate transfer, creating a significant market for system evaluations. The MPCA's ISTS program emphasizes performance standards over prescriptive design: systems must be designed to achieve a specified treatment level based on site-specific soil and water table conditions. Mound systems are extremely common in Minnesota given the state's flat terrain, high water tables, and glacial lake-bed soils. Setbacks require 50 feet from lakes and streams classified as public waters, 75 feet from public water supply wells, 10 feet from property lines, and 3 feet from the seasonal high water table for drainfield bottoms.
